Eiffelgres3D
Eiffelgres3D is a design software for architects and designers, a useful aid for creating precision layouts and three-dimensional plans of interior spaces and customising them with Eiffelgres materials.
Advanced rendering and animation functions allow architects to give concrete form to their ideas and see all the possible floor and wall coverings they can create with the variety of colours and surfaces offered by Eiffelgres materials.

USER LICENCE and COPYRIGHT
for the Eiffelgres3D software
This contract is entered into between the end user and the Eiffelgres Division of Iris Ceramica S.p.a. and concerns the software called Eiffelgres3D contained in the attached CD-ROM.
USE OF THE CD-ROM AUTOMATICALLY IMPLIES ACCEPTANCE OF THE TERMS OF THIS CONTRACT. ANYONE NOT INTENDING TO COMPLY WITH THE CONDITIONS OF THIS CONTRACT SHOULD RETURN THE CD-ROM AND ANY OTHER MATERIAL ATTACHED TO IT PROMTPLY (including the added written material or any other material present). SALE IS FORBIDDEN.
1. User’s rights
With this Contract, the Eiffelgres Division of Iris Ceramica S.p.a., hereinafter referred to as Eiffelgres, grants the end user the right to use a copy of the specific version of the software contained in the attached CD-ROM on any single computer. If the end user has been authorised for multiple use, he/she may have the same number of copies of the CD-ROM for simultaneous use as the number of authorisations received. The software contained in the attached CD-ROM is understood to be ‘used’ on a computer when it is loaded in the temporary memory (RAM) of that computer or installed in a permanent storage unit (hard-disk, CD-ROM, etc.) thereof.
2. Copyright
The software procedures contained in the attached CD-ROM are the property of OMNI DATA Srl - Via S. Prospero, 17/c - Correggio (RE) – ITALY, and use of an indefinite number of copies thereof has been granted by the latter to Eiffelgres for an indefinite period of time.
The software is protected by Italian copyright law, by the provisions of International and EEC treaties and by other applicable national laws.
The user is therefore under the obligation to treat the software like any other material covered by copyright (e.g. books or music records).
The user may not in any case reproduce the attached and accompanying material.
The user may not use the software of the attached CD-ROM in the form of unlicensed copies, and may not sell or lend it, rent, lease or transfer it to any other user except as part of a conveyance or for another use expressly permitted under this contract.
3. Restrictions
The user may not convert, decode, decompile or disassemble the software contained in the attached CD-ROM. The user may not use the attached CD-ROM for other programmes except as expressly requested and granted by Eiffelgres as the owner of all the data, images, filmed material etc. contained in it.
The user may not distribute the data of the attached CD-ROM.
4. Breach of contract
In the event of a breach of any of the stipulations contained in this contract and/or of the laws governing matters of software user licenses and copyright, the user will be under the obligation to return the copy (copies) of the CD-ROM(s) received for use, if requested to do so even verbally by Eiffelgres and without being entitled to prior notice or indemnification of any kind. The licensor will in any case be entitled to claim damages.
5. Limits of the warranty
The hardware material (CD-ROM, discs) is warranted free from physical and manufacturing flaws in normal conditions of use and service, for a period of one year from the date of delivery.
In the event of loss, destruction, breakage, wear, etc., the user may request replacement following written and signed notification of the incident in question.
6. Protection of the User
Responsibility towards and remedies for the user will be at the discretion of Eiffelgres, in accordance with one of the following two options:
(a) return of the software and termination of the user contract, (b) repair and/or replacement of the software. This warranty is not applicable if the flaw in the software is due to an accident, improper functioning of the hardware, improper use or incorrect application.
7. Exclusion of other warranties
Eiffelgres does not acknowledge any other warranties, whether express or implicit, including, among the others, warranty of suitability for a specific use by the user.
8. Exclusion of liability for indirect damages
In no case will Eiffelgres be liable for damages (including but not limited to damages due to foregone or loss of earnings, interruption of activity, loss of information or other financial losses) arising out of use of the software contained in the attached CD-ROM, even in the event that Eiffelgres has warned that such damages may be possible.
This contract is governed by Italian law and subject to the sole jurisdiction of the legal judicial authorities. The sole court of competent jurisdiction for any disputes concerning and/or arising out of this contract will be the Court of Modena.
9. Conclusion
I hereby declare that I have read and specifically approve clauses 2,3,4,5,6,7 and 8.
